1. Acceptance of Terms
By creating an account or using any part of the Pawania platform — including the website, mobile apps, TV app, or any API — you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, you may not use the platform. We may update these terms from time to time. Continued use after an update constitutes acceptance of the revised terms.
2. Eligibility
You must be at least 13 years old to use Pawania. If you are under 18, you must have permission from a parent or legal guardian. By using the platform, you confirm that you meet these age requirements and that all information you provide is accurate and complete.
3. Accounts
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify us immediately at support@pawania.com if you suspect any unauthorised access. We reserve the right to terminate accounts that violate these terms.
4. User Content
You retain ownership of the content you upload to Pawania. By posting content, you grant Pawania a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, modify (for formatting purposes), and display that content solely to operate and improve the platform. You are solely responsible for your content and must ensure it does not infringe any third-party rights, contain illegal material, or violate our Community Guidelines.
5. Prohibited Conduct
You agree not to: (a) upload content that is illegal, harmful, abusive, or violates any third-party rights; (b) use the platform to harass, threaten, or impersonate others; (c) attempt to gain unauthorised access to any part of the platform; (d) use automated tools to scrape or extract data without written permission; (e) engage in fraudulent transactions or manipulate the token economy; (f) violate any applicable laws or regulations.
6. Pawania Tokens (PTK)
Pawania Tokens (PTK) are platform credits used for transactions within the platform. They are not a cryptocurrency, investment, or legal tender. Tokens are purchased with fiat currency and may be earned by creators. Commission rates on token purchases and cash-outs are set by platform administration and are subject to change with reasonable notice. Tokens have no cash value outside the platform and are non-transferable except through supported platform features.
7. Payments and Fees
All payment transactions are processed by third-party payment providers (M-Pesa, Stripe, etc.). Pawania does not store payment card data. Platform commission rates are admin-configurable and will be clearly disclosed at the time of each transaction. Creator earnings are subject to a 48-hour holding period before becoming eligible for cash-out.
8. Intellectual Property
The Pawania name, logo, and platform interface are the exclusive property of Pawania. Nothing in these terms transfers any intellectual property rights to you. You may not use our trademarks, brand assets, or platform code without prior written permission.
9. Limitation of Liability
To the maximum extent permitted by applicable law, Pawania and its officers, employees, and partners shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the platform, including loss of data, loss of profits, or business interruption. Our total aggregate liability to you shall not exceed the greater of USD 100 or the total fees you paid to us in the 12 months preceding the claim.
10. Termination
You may delete your account at any time. We reserve the right to suspend or terminate any account that violates these terms, at our sole discretion, with or without notice. Upon termination, your licence to use the platform ends immediately. Provisions that by their nature should survive termination will do so, including ownership clauses, warranty disclaimers, and limitations of liability.
11. Governing Law
These terms shall be governed by and construed in accordance with the laws of the United Republic of Tanzania, without regard to conflict of law principles. Any disputes shall be resolved through binding arbitration in Dar es Salaam, Tanzania, except where prohibited by applicable local law.
